Conditions of Use
1. General Rules And Definitions
1.1 This site is operated by FAB ("We" or "FAB"). By viewing the content of fabnyc.org ("The Site") and downloading its pages, you agree to abide by the policies contained in this agreement.
1.2 FAB may change, add or remove portions of this agreement at any time. We will post such changes on this page. It is your responsibility to review this agreement prior to each use of the site and by continuing to use this site, you agree to any changes.
2. Copyright Notice
2.1 All materials contained on this site are protected by United States copyright law and may not be reproduced, distributed, transmitted, displayed, published, broadcast, or in any way exploited without the prior written permission of FAB or in the case of third party materials, the owner of that content. You may not alter or remove any trademark, copyright or other notice from copies of the content.
2.2 However, you may download material from The Site for your personal, noncommercial use only.
2.3 Links to web sites other than those owned by FAB are offered as a service to visitors. FAB is not responsible for their content.
3. User Generated Content
3.1 You shall not upload to, or distribute or otherwise publish on The Site any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.
3.2 You agree that you will not threaten or verbally abuse other Members, use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages or "spam."
3.3 You agree not to use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of The Site.
3.4 The Site shall be used only in a noncommercial manner. You shall not, without the express approval of FAB, distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services.
3.5 You are solely responsible for the content you post on The Site. However, FAB reserves the right to delete, move, or edit content that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.
3.6 You acknowledge that any submissions you make to The Site (i.e., user-generated content including but not limited to: text, video, audio and photographs) (each, a "Submission") may be edited, removed, modified, published, transmitted, and displayed by FAB and you waive any moral rights you may have in having the material altered or changed in a manner not agreeable to you. You grant FAB a perpetual, nonexclusive, world-wide, royalty free, sub-licensable license to the submissions, which includes without limitation the right for FAB or any third party FAB designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed, any submission posted by you on or to The Site or any other website owned by FAB, including any Submission posted on The Site through a third party.
4. Transaction Fee
Transaction fees are assessed per item purchased. Transaction fees cover costs charged by credit card and merchant processing companies to FAB. FAB maintains the absolute lowest fees to our customers.
5. Third Party Offers
FAB does not represent or endorse the accuracy or reliability of any of the information, content or advertisements contained on, distributed through, or linked, downloaded or accessed from any of the services contained on our website, nor the quality of any products, information or other materials displayed, purchased, or obtained by you as a result of an advertisement or any other information or offer in or in connection with any service. You hereby acknowledge that any reliance upon any materials shall be at your sole risk.
6. Merchandise Policies
6.1 RETURNS AND EXCHANGES
Please call the merchant you purchased the item from before you return item. The merchant’s phone number is available on their shopping page. If something isn’t right with the order contact the merchant you purchased it from within 10 days. You will have 40 days to return the item in its original condition and packaging. Please remember you are responsible for the shipping cost and packaging so that the merchant receives the item in good condition. Merchandise can be returned for store, either online or at a physical point of sale, credit only. A store credit is valid for one year. You will be emailed a confirmation of the return and the credit within 5 business days of its receipt.
6.2 SHIPPING AND HANDLING
Shipping is calculated based on the weight of each item and where the item or items are being shipped. This fee will be calculated during checkout. Items are shipped within 7 business days. Purchases made after 5PM will be shipped within 7 business days of the following business day. Merchants will not ship to P.O. boxes and require signature confirmation, unless waived by the purchaser. Merchants cannot be responsible for the loss or damage of a package once a delivery is confirmed by a signature or if authorized to be left without a signature.
